The truth is that these provisions are fertile ground for purchasers to assert breach and make substantial damages claims against the vendor.

This face-to-face workshop will:

• provide attendees with an increased understanding of vendor warranties;
• consider the importance of vendor warranties from the perspective of the purchaser, and the remedies available to a purchaser where a warranty is breached, including actions for breach of warranty and under the Australian Consumer Law;
• consider the risks and dangers of vendor warranties from the perspective of the vendor;
• discuss recent case examples involving breaches of vendor warranties;
• explore measures that can be taken to secure entitlements upon breach of vendor warranties and to guard against insolvency risks; and
• assist attendees in making effective suggestions to improve their client’s risk position.
